Chapter IV C Additional powers of the Works Council
Article 32
- Powers in addition to those mentioned in this Act may be granted to the Works Council or Works Councils of the enterprise or enterprises party to that collective agreement or arrangement by means of a collective labour agreement or an arrangement relating to terms of employment laid down by a body under public law.
- P owers in addition to those mentioned in this Act may be granted to the Works Council as well as additional stipulations concerning the application of provisions of or pursuant to this Act by means of an agreement in writing between the entrepreneur and the Works Council. The entrepreneur shall send a copy of the agreement to the Joint Sectoral Committee.
- If, on the basis of this Article, the Works Council is granted advisory powers or the right to endorse decisions, the advice or endorsement of the Works Council shall not be required insofar as the substance of the matter has already been regulated for the enterprise in a collective labour agreement or in an arrangement relating to terms of employment laid down by a body under public law.
- If, in such an agreement, the Works Council is granted the right to render advice on or to endorse proposed decisions by the entrepreneur, other than those mentioned in Articles 25 and 27 respectively, then Article 26 and Article 27, paragraphs (4), (5) and (6), shall apply respectively, mutatis mutandis.
